MANAGEMENT AGREEMENT

This Agreement is made and entered in the             day of  _________, 20____, between                                                  of Address: (                                                                                , hereinafter called “Owner”, and  Joyous Vacations LLC / Short term Home Rentals. , hereinafter called “Channel Manager”.

Owner hereby employs the services of the Manager to manage, operate, control, short term rent and lease the following property:

Responsibilities of Manager

     The Owner hereby appoints Manager as his agent with full authority to do any and all lawful things necessary for the fulfillment of this Agreement, including the following:

1. To collect all rents due for Rentals by Joyous Vacations LLC and not previously collected by the owner, giving receipts therefore; to render to the Owner a monthly accounting of rents received and expenses paid out; and to remit to the Owner ____% of rentals received by Joyous Vacations LLC. Joyous Vacations LLC has the responsibility to try and keep the property occupied as often as possible with exception to dates blocked out by the owner. As a result, Joyous Vacations LLC may vary the rate depending on rental traffic and the demand for the property.

2. To make or cause to be made all decorating, maintenance, alterations and repairs to said property and to hire and supervise all employees and other labor for the accomplishment of same. These services will be performed only if requested and approved by letter or e-mail from the owner. The owner is responsible for all costs associated with approved contractor services to include plumbing, electrical, spa or pool maintenance, pump repair, septic repair or maintenance, phone repair, internet repair, satellite TV repair, and all improvements made to the property such as painting, staining, landscaping, and snow removal. It is the responsibility of the manager to oversee and make sure that the said work was performed in a timely and cost-effective manner and to notify the owner of any problems that they perceive to exist. Manager may not be held liable for the quality of the work or the effectiveness of the work.

3. Joyous Vacations LLC will see that the property is ready for rentals (turn on pump, turn up heat, etc), make sure the home is cleaned after the rental and that all check out items have been performed.

4. Joyous Vacations  LLC will check on all properties once per week and during the peak winter months when the weather is the coldest (November through March), we charge an extra $_________ per month to check on the home at least twice per week and sometimes 3 times per week depending on the temperatures. This is to help insure that your home does not have frozen pipes or frozen septic tanks. We turn on all water and run it for at least 10 minutes and flush all toilets and look for any frozen pipes or leaks. Joyous Vacations LLC does not guarantee that your home will not have frozen pipes or septic but checking on the home more often will help prevent such damages. Joyous Vacations LLC or any employee thereof is not responsible for frozen pipes, frozen septic, break-ins, damage by wind, snow, weather or any other damage. If the damage is from a renter, we will file a claim with Travel Guard to get the damage repaired and attempt to charge their credit card on file for any damages exceeding what the policy coverage. We cannot guarantee that all damages will be covered and repaired. The homeowner may incur some expenses for damages not covered or that we are not able to get back from the renter. There will always be routine maintenance items from renting that the homeowner is responsible for like painting, deck repairs, hot tub repairs, new towels and linens, etc.

5. To advertise the property and display signs thereon if requested; to rent and lease the property; to sign, renew and cancel rental agreements and leases for the property or any part thereof, if requested by the owner; to attempt to recover for rent and for loss of or damage to any part of the property and/or furnishings if requested by the owner.

6. To check the property, by request, after the homeowner or family and friends visit the property. The home owner will be billed for any cleaning fees, damages, and/or maintenance associated with the property check after their visits.  Joyous Vacations LLC will not have access to the security deposit for rentals made by the homeowner and thus the homeowner will be responsible for collecting money for the renters for any damages, maintenance, taxes, or cleaning for their own rentals, family or friends. Joyous Vacations LLC charges ____% of any rental fees collected by the homeowner for their own rentals. In return, Joyous Vacations LLC will see that the property is ready for the rental.

Liability of Manager

Owner hereby agrees to hold Manager Joyous Vacations LLCharmless from any and all claims, charges, debts, demands and lawsuits, including attorney’s fees related to the management of the herein-described property, and from any liability, theft, damage, or  injury on or about the property which may be suffered by any employee, tenant , guest upon the property, or owner of the property. Joyous Vacations LLC is not responsible for any damages to the property due to failure of heat, frozen pipes, frozen sewer lines, hot tub failures, or any other mechanical failure or natural disaster. We retain the right to move renters to another home should the home become uninhabitable due to mechanical failure or natural disasters. Monies will be transferred to the homeowner of the home that the renters are moved to.

Compensation of Manager

Owner agrees to compensate Manager as follows:

$____________  non-refundable start-up cost which includes ½ of VRBO and updates to all websites and flyers. If this contract is cancelled by the homeowner within the first year or if the house is sold within the first year,   ½ of the VRBO fees have to be paid back to Joyous Vacations LLC within 30 days of cancellation of the contract (including sale of the home).

$________ per month November through March for extra property check on the home during peak winter months (optional).  If the homeowner elects to have their home checked during these months, we do so at least twice per week and sometimes 3 times per week if temperatures are predicted to be more than 20 below zero. If you do not elect to have your home checked twice per week, it will be checked once per month at no charge and Joyous Vacations LLC and any of it’s employees cannot be held responsible for any frozen pipes, sewers, toilets or any other damage related to cold temperatures or other natural disasters. The volatile weather in the area maybe necessitates this option. Pipes can freeze within a day in the extreme temperatures and checking the home 2-3 times per week is the best preventative. It is not absolute assurance that there will not be problems from freezing but if caught early, it can save a homeowner thousands of dollars.

Short Term Rentals by Joyous Vacations LLC: _________ of all rental monies collected for any rental between 1 and 6 months.  If the home is equipped with a hot tub, the fee is __________ of rental monies collected. Should the owner agree to a longer term rental arranged by Joyous Vacations  LLC, there is a _____% of rental amount per month for the term of the rental if Joyous Vacations LLC refers the renter to the homeowner.

Term of Agreement  

The term of this Agreement shall commence on the         day of                            , 20__ and end upon termination of this contract by either party.  Upon termination of this contract, the owner agrees to give the Manger 30 days notice and continue to pay the compensation due as agreed to above during that 30 day period. Joyous Vacations LLC has the right to take any rentals during that 30 day period. The manager also agrees to give the owner 30 days notice upon termination of this contract. All upcoming rentals shall be honored during this 30 day period. Any future rentals would be transferred to a different home or the monies refunded to the renter. If the home sells prior to upcoming rentals, we request that the condition of allowing the rentals to take place be placed in the contract with the new homeowner.

This contract shall remain in effect until either the Owner or the Manager notifies the other in writing of the request to terminate the contract. If it is not a mutual agreement, then the rentals will continue to be honored for 30 days.

This Agreement may also be terminated immediately by mutual agreement of both parties at any time upon payment to Manager of all fees, commissions and expenses due Manager under terms of this Agreement.

Extent of Agreement

This document represents the entire Agreement between the parties hereto.
